These Terms of Use ("Terms") govern your use of Tempoist ("Tempoist," "the app," "we," "us," or "our"), operated by Carl Hinkle as a sole proprietorship in Connecticut, United States, and of its pages on runthroughapp.io. By downloading, installing, or using Tempoist, you agree to these Terms. If you do not agree, do not use the app.

Please also read the Privacy Policy, which explains how information is handled.

1. Licensed application

Tempoist is a Licensed Application under the Apple Standard End User License Agreement (EULA). Apple's Standard EULA applies to your use of the app obtained through the App Store, and these Terms add product-specific terms that do not conflict with that EULA.

2. What Tempoist is

Tempoist is a metronome with tap tempo for iPhone and iPad. It is distributed through the App Store and works without an account or an internet connection.

3. Acceptable use

You agree not to:

  • Reverse engineer, modify, or redistribute the app except as allowed by law or Apple's Standard EULA
  • Use the app in any way that violates applicable law
  • Attempt to interfere with the app's normal operation

4. Purchases and refunds

Tempoist has no in-app purchases. Any price for the app is shown in the App Store and charged by Apple. Refund requests are handled by Apple under Apple's refund policies.

5. Disclaimer of warranties

Tempoist is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. When you hear the click or feel the vibration can vary with your device and how it plays sound, for example over Bluetooth headphones.

6. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of Tempoist. Our total liability for any claim relating to the app will not exceed the amount you paid for Tempoist.

7. Changes to these Terms

We may update these Terms from time to time. The effective date at the top of this page will change when we do. Continued use of Tempoist after an update means you accept the revised Terms.
